US work visa rule tweaked to keep migrant workers

Posted by:

The United States do not want to lose highly skilled foreign workers, and so, to prevent this from happening, the country has expressed its plans to make a minor tweak in the prevailing visa rules and may soon start implementing it for migrant workers in the US.

The old visa rule goes like this: Migrant workers who has an H-1B visa, the visa issued to those who secured a job in the US under a company sponsorship are allowed to work under a limited term/contract. IF their spouses plan to go to the US and stay with them, they can get an H-4 visa (which allows them to stay in the US but not to work).

Under the revised visa rule, a spouse of an H-1B visa holder may also get the same visa to be able to work in the US, live with their partner and thus, retaining the highly skilled worker.

The visa rule change also applies to spouses of H1-B visa holders who have applied for green cards or permanent residency cards.

This move by the United States is aimed to retain highly skilled migrant workers especially in the science and technology industry and help n the growth of the US economy.

The visa rule change will be available after it is published in the Federal register and open for public comment.

US Law Removes Quota on Skilled Foreign Workers

Posted by:

The US House of Representatives recently passed a bill that would remove the quota in high skilled working visa. This means that it would be faster and easier to deploy computer scientists, engineers and other foreign skilled workers and professionals.

The “House Resolution 3012” or the “Fairness for High-Skilled Immigrants Act,” was approved after receiving a favorable vote from 389 US lawmakers.

This bill was sponsored by Republican Rep. of Califoirnia, Jason Chaffetz of California. It aims to promote family unity for legal immigrants who want to petition their relatives.

The new bill is expected to increase deployment of talented immigrants from India, Philippines, Chinaand other countries. The new law would also increase the quota for family green cards to 15% of a total of 226,000. Past quota is 7% of 226,000m thus would reduce backlogs for Filipino and Mexican immigrants.
